EPA to Propose New Source MACT by November 20, 2012
In a monthly update required by the court, EPA announced that it will issue the proposed Mercury and Air Toxics Standards (MATS) for new sources by November 20, 2012. EPA also stated that it had sent the proposal to the Office of Management and Budget for an expedited review on November 7, 2012 and that the rulemaking is still on track to result in a final regulation by March 2013.

EPA issued the original MATS in December 2011 but subsequently announced in July 2012 that it would reconsider the new source provisions, including measurement issues related to mercury and the data set used for variability calculations for particulate matter and hydrochloric acid. In September 2012, the court agreed to hold legal challenges on the MATS rule in abeyance while EPA reconsidered the new source standards. The agreement called for EPA to submit monthly status reports, such as the one issued on November 13, 2012.
