The objectives of this paper are: first, to set out the legal and policy foundations of the federal-Indian trust relationship; second, to describe the part the federal-Indian trust relationship can play in instructing the U.S. Environmental Protection Agency (“EPA”) as to its responsibilities to clean up hazardous waste sites in Indian country; and third, to suggest a strategy that Indian tribes and EPA can use to begin the cleanup of hazardous waste sites in Indian country.
