This presentation was delivered as part of the Tribal Lands and Environment Forum: Virtual Gathering in August 2021 by Michael Hartnett with the KSU Tribal TAB and Helen Dangel with the Sitka Tribe of Alaska. CERCLA Section 128(a) Elements 2 & 4 address the cleanup of Brownfields and the review and approval of Cleanup Plans and verification of Cleanups. Tribes need to develop the internal resources, mechanisms and protocols for such reviews and approvals prior to when they are needed. This may include the review and comment on cleanups conduced under state federal or other authorities. This session will provide an example of the development of tribal SOPs for such reviews and approvals. Tribes can access other tribal experiences as well as technical assistance from other programs such as the EPA TAB Program.
